Chronology and catalogue links — assessed 10-10-2026: Use the Institutional Involvement Roadmap (1877–2026) for the date-ordered institution/people/evidence sequence. The reported 1988 Cadw-to-Minister spot-listing letter has its own catalogue placeholder at GHF-E152; the original has not been attached to that page as at 10-10-2026. A placeholder records an evidence gap; it does not establish the letter’s contents or misconduct.

Forensic Assessment — High Court

Scope: the High Court’s historic possession proceedings and judicial record, not allegations of judicial misconduct.

Critical role

The 1955 High Court proceedings produced the possession order later relied upon in the ownership/adverse-possession history. The published 1987 appeal report says the Order 14 order was against Frederick and described as covering the whole farm; execution on 4 July 1955 left the farmhouse and garden undisturbed. The court’s adjudicative role is to be scrutinised on the land, title and tenancy case actually put before it, not merely as a custodian of a later record.

A second, distinct High Court stage was Hollis J’s 1986 trial. Dillon LJ later disagreed with Hollis J’s conclusion that Frederick lacked the necessary intention to possess, but dismissed the appeal on the basis of the 1962 order and 1974 letters. The evidence test is whether the 1986 court had and decided the full Parcel-A root-title/earlier limitation case, or whether the case presented to it had become confined to possession and limitation from 1953/1955 for the farmhouse and garden. The complete trial judgment, pleadings, witness evidence, plans and trial bundle are necessary to answer that.

Two High Court stages must not be conflated

The 1955 Order 14 possession proceeding and Hollis J’s 1986 trial are different judicial events. The 1955 claim/order/warrant determines what land was legally ordered to be recovered and what was physically taken on 4 July 1955. The 1986 judgment determines the adverse-possession defence concerning the occupied farmhouse and garden. Neither should be described as a parcel-by-parcel adjudication of the full 1877/1928 Parcel-A root title unless the actual pleadings, evidence and reasons show that issue was put and decided.

The 1954 further attempt to make Frederick a tenant, now tracked as GHF-E182 (original source pending), should be compared with the 1949–1953 periodic agricultural tenancy accepted in the later appeal judgment. The court’s finding that a periodic tenancy existed despite no written agreement is not the same thing as proof that the tenancy covered Parcel A. The proposed tenancy’s exact wording, intended parcel and outcome matter.

Earlier title / limitation case and judicial role

The family’s alternative case is that the twelve-year limitation period, already present in the Real Property Limitation Act 1874, may have completed by about 1940 if Parcel-A occupation became adverse in 1928. This remains conditional on proof of the relevant owner, parcel, factual possession, intention and absence of permission or other interruption. The High Court’s 1955 order is therefore not just a records question: scrutinise the court’s role in deciding what land WGR was entitled to recover from Frederick, what “whole farm” meant in the claim and order, and whether evidence distinguishing Parcel A from Parcel B was before the judge.

The 1954 further tenant-making attempt is separately recorded in GHF-E182, with its original source pending. The accessible 1987 appeal report does not mention 1954 and should not be cited as support for this event unless a separate source provides the passage. The 1949–1953 agricultural tenancy recognised by the Court of Appeal is not the same question as whether the distinct Parcel-A home/quarrying estate was within that tenancy.

Forensic control test

Compare the 1955 claim, order, plan and warrant with the 4 July execution record and parcel plan. Separately reconstruct what evidence about the tenancy, Mary’s ownership assertion, Frederick’s intention and the 1954 attempt was before Hollis J in 1986. The humanitarian explanation for leaving Mary in the farmhouse should not be converted into proof that the house was legally outside the order; equally, “whole farm” wording should not substitute for establishing the order’s geographic extent.

Current finding

As at 10-10-2026, the material reviewed does not establish judicial wrongdoing in relation to the proceedings reviewed. This does not conclude that every procedural or evidential issue is resolved. The significance is evidential: the 1955 record may explain the later starting point of the adverse-possession analysis and whether Parcel A was genuinely within it.

Human action

Obtain the complete High Court file and execution record and place it beside the 1939 plan, 1949 surrender/re-grant and 1962 farmhouse proceedings.

Acceptance: exact legal effect and physical extent of the 1955 order are either established or formally unresolved for a specific evidential reason. 🕒10-10-2026
